Kelly Rutherford News: 'Gossip Girl' Star Gains Full Custody of Her Children
Kelly Rutherford, star of the hit television drama, Gossip Girl, has been granted sole legal and physical custody of her two children, temporarily. This occured after a California judge ruled that her son, Hermes, who is eight years old, and her daughter, Helena, who is six years of age, be brought back to the United States from Monaco.
They had been living with their father, Daniel Giersch in Monaco since 2012.
The children must travel back to Los Angeles, and their passports will be kept by their mother, according to a court order which was filed on Friday.
A hearing at the LA Superior Court is scheduled for June 15, 2-15, as which Rutherford, her two children and either Giersch or his representative is all required to be present.
This news comes after Rutherford made a statement to People in which she said that Giersch would not allow her to see her children after she arrived in France to visit them, unless she complied with his demands of handing the childrens' United States passports to a member of his legal team.
In a statement to People magazine, Rutherford's lawyer, Wendy Murphy says that Rutherford is extremely happy to see her children return home.
"We are ecstatic, and hopeful that Monaco will respect the California court's ruling and send the children home," stated Murphy. "If the citizenship shoe were on the other foot and these children were citizens of Monaco, I have no doubt that the United States would respect their right to reside in Monaco."
Rutherford filed for divorce in 2009 when she was pregnant with Helena.
