Kelly Rutherford News: Actress Wins Sole Custody of Two Children After Long Custody Battle
After years of custody legal battles between 'Gossip Girl' actress Kelly Rutherford and ex-husband Daniel Giersch, a recent California Court ruling just granted Rutherford sole custody of her two children who are both currently in Europe with him.
It has just been ordered according to the recent statement by Rutherford's lawyer, that the actress' two children, Hermes, age 8 and Helena, age 5, will now be in her custody. For those that may not know, both children are U.S. citizens despite previous contradictions made by Giersch's party.
"We are ecstatic, and hopeful that Monaco will respect the California court's ruling and send the children home," Rutherford's lawyer Wendy Murphy told People magazine last Sunday. "It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country."
Court documents surfaced afterwards confirming the news that Rutherford indeed is granted sole custody after years of battling legally with her ex-husband. "for the purpose of returning the two minor children to the United States, and in particular, to Los Angeles County, [Rutherford] is awarded sole legal and physical custody of the minor children pending further orders of this court", according to court documents posted online by The Krim Group, a group affiliated with the actress and other celebrities.
Previously, tension rose when the party of Giersch, who was known to be deported back in his home in Europe failed to cooperate and provide Rutherford access to the children. Court documents say that "to exercise her periods of physical custody...both in France and in the United States," at least twice since October 2014.
"Daniel has taken and will continue to take all necessary security measures to ensure that the children are not wrongfully removed from Europe and remain safe, healthy, happy and protected from any such threats to their safety and well-being," Giersch's lawyer previously told E! News.
Now that the case is settled, Rutherford being granted sole custody, will also retain possession of the children's U.S. passports. A hearing on June 15 is also scheduled for Rutherford and her children to attend to.
